These terms and conditions shall apply to any hire transaction between Accudata Ltd (the owner) and the customer unless any variation is agreed and accepted by the owner in writing.
The period of hire is defined to start from the day after the day of despatch from our works and to terminate on the day of notification of hire termination from the customer.
The rental period starts on the day after despatch.
The rental period ends on the day of notification of hire termination from the customer.
The minimum hire period is one week, being 5 working days. Additional days will be charged at a daily rate.
Notice of termination of hire shall be one day given in writing by either party at any time.
Payment terms are nett 30 days for account holders, otherwise payment with order.
The equipment shall remain the property of the owner and is supplied to the customer only on a rental basis.
During the hire period the customer shall be responsible for the following:
The customer will sign to acknowledge receipt of the equipment at delivery/handover. Any shortages, damages or defects should be notified immediately by telephone.
The customer assumes the entire risk of loss or damage to the equipment however sustained. The hirer must undertake to insure the equipment at their own expense. Damaged equipment will be charged at the prevailing list price to the customer.
Any attempt by the customer to repair, modify or tamper with any equipment supplied for rental will render the customer liable to a charge for reinstatement of the equipment to its original state and specification.
The customer undertakes to permit operation of the equipment by staff deemed capable of operating the equipment in a suitable and proper manner.
The customer undertakes to store the equipment in a suitable area and to take responsible care to mitigate the effects of water, heat and other elements.
The customer is to keep the equipment in good condition and ensure it is not subject to misuse.
The customer is to immediately notify the owner in writing of any loss or damage to the equipment. The customer shall be liable for such loss or damage and rental shall continue to be chargeable until settlement for such loss or damage is made to the owner.
At the end of hire the customer is to notify the owner of a collection address, site contact name and telephone number. The owner can place the equipment back on hire if this information is incorrect and leads to failed collection attempts.
Equipment must be packed in the original packaging as delivered.
After post hire inspection, any repairs necessary to return the equipment to the manufacturer’s specification on completion of hire shall be chargeable to the customer. Any parts used will be charged at full replacement cost.
The owner retains the right to terminate the contract and repossess the equipment without affecting any rights to recover monies due, damages for breach of contract or other remedies where the customer is in breach or is involved in insolvency or liquidation proceedings. Ownership of the equipment remains with Accudata Ltd.
